Interpyro Terms and Conditions
These terms apply to the use of the Interpyro platform, auctions and purchases.
1. General provisions
1.1 These Terms and Conditions apply to the use of the Interpyro online platform and to all purchases, bids and other transactions concluded through the platform.
1.2 Interpyro is a company established in Germany that operates an online platform on which legal consumer fireworks and other lawfully permitted pyrotechnic articles for the German market are offered.
1.3 By registering, placing a bid, purchasing a product, or otherwise using the platform, the user agrees to these Terms and Conditions, to the extent legally permitted.
1.4 Mandatory statutory provisions, including consumer-protection provisions, always take precedence over provisions in these Terms and Conditions.
2. Interpyro's role
2.1 Unless expressly stated otherwise on the relevant product page, Interpyro acts as the contractual seller vis-à-vis the consumer.
2.2 The consumer enters into the purchase agreement with Interpyro.
2.3 The consumer pays the purchase price and any additional costs to Interpyro.
2.4 Interpyro receives the consumer's payment and handles the administrative and financial processing of the purchase.
2.5 The physical products are held by the relevant affiliated German vendor. Interpyro does not receive the physical products and does not transport or ship them to the consumer.
2.6 The affiliated German vendor is responsible for the physical storage, safekeeping, preparation, and actual handover of the products purchased by the consumer through Interpyro.
2.7 The vendor acts as Interpyro's fulfilling vendor partner in the physical handover of the product.
3. Affiliated vendor partners
3.1 Every vendor offering products through Interpyro must be a professional trader established in Germany and must hold all licences, registrations, authorisations and insurance required for its activities.
3.2 The vendor is fully responsible for the legal lawfulness of the products it offers, their storage, and the physical handover to the consumer.
3.3 The vendor guarantees to Interpyro that all products it offers are actually available and remain available to Interpyro and the consumer throughout the entire duration of the relevant listing.
3.4 As soon as a product is sold through Interpyro, the vendor must immediately reserve that product for the relevant consumer.
3.5 The vendor may not sell, transfer, reserve, or otherwise remove a sold product from stock for any other person.
3.6 The vendor may not cancel a won auction because, in its opinion, the realised sale price is too low.
3.7 The vendor is responsible for the accuracy and completeness of all product information it supplies.
3.8 The vendor is responsible for the conduct of its employees, representatives and any third parties it engages.
4. Statutory requirements for fireworks
4.1 Interpyro only offers products that, according to the seller's information, may lawfully be sold to consumers in Germany.
4.2 The vendor guarantees that every pyrotechnic article it offers complies with all applicable German and European statutory regulations.
4.3 The vendor is responsible for, among other things:
- a. the correct classification of the product;
- b. the required CE marking and other statutory markings;
- c. correct packaging;
- d. correct labelling;
- e. the required safety information;
- f. lawful storage;
- g. lawful sale;
- h. lawful handover;
- i. the required licences and authorisations;
- j. compliance with all applicable fireworks and safety regulations.
4.4 Interpyro is entitled to immediately remove a product from the platform if there is doubt about its lawful marketability, safety or conformity.
5. Age and identity
5.1 Participation in auctions and purchases via Interpyro is only permitted for persons who are at least 18 years old.
5.2 For products subject to a statutory minimum age, handover may only take place if the buyer meets all statutory age requirements.
5.3 At pickup, the vendor may require a valid form of identification.
5.4 If the buyer cannot demonstrate that they are entitled to receive the relevant product, the vendor may not hand it over.
5.5 Failure to demonstrate the required age or identity may result in the handover not being carried out, in accordance with the applicable statutory provisions.
6. German market
6.1 The pyrotechnic articles offered through Interpyro are intended exclusively for the German market.
6.2 Interpyro does not offer international shipping or export of consumer fireworks.
6.3 The buyer is solely responsible for checking whether a product may be transported, imported, stored, sold or used outside Germany.
6.4 If a buyer takes, transports, imports, stores, sells or uses a product purchased through Interpyro outside Germany, this is done entirely at the buyer's own expense and risk.
6.5 The buyer is fully responsible for all applicable legislation in the destination country, including:
- a. import rules;
- b. export rules;
- c. customs regulations;
- d. transport regulations;
- e. permits;
- f. storage regulations;
- g. sales restrictions;
- h. usage restrictions;
- i. taxes and levies;
- j. fines and other sanctions.
6.6 Interpyro does not guarantee that a product which may lawfully be sold to consumers in Germany may also lawfully be imported, transported, stored or used in another country.
6.7 To the extent legally permitted, Interpyro is not liable for any consequences arising from a buyer taking a product outside Germany or using it there.
7. Product listings
7.1 Products are offered on the platform with a description, images and other relevant information.
7.2 The product information must enable the consumer to make an informed purchasing decision.
7.3 The affiliated vendor is responsible for the accuracy of the product data it supplies.
7.4 Images are for illustration purposes. Minor deviations in packaging or presentation do not automatically entitle the buyer to cancellation if the product delivered substantially matches the description.
8. Online bidding
8.1 Interpyro offers products via an online bidding mechanism.
8.2 A bid is placed using the functionality provided for that purpose on the platform.
8.3 By placing a bid, the user declares its willingness to purchase the relevant product for the amount bid, provided it is the highest valid bid and the other conditions for concluding the agreement are met.
8.4 The user is solely responsible for every bid it places.
8.5 An accidentally placed bid can only be withdrawn if this is permitted under the applicable statutory provisions.
8.6 The size of the bid increments is determined by Interpyro.
8.7 Interpyro may apply different bid increments per auction.
8.8 If Interpyro offers an automatic bidding mechanism, the user can set a maximum bid amount.
9. End of the auction
9.1 The auction ends when the end time indicated on the platform is reached, except in the case of technical faults, manipulation, fraud or other circumstances that prevented the bidding process from taking place reliably.
9.2 The highest valid bidder is declared the winner of the auction.
9.3 If a reserve price applies to an auction, the auction is only won if the reserve price is reached, unless stated otherwise on the relevant product page.
9.4 Interpyro may cancel or re-run an auction in the event of demonstrable technical errors, fraud, manipulation, or other circumstances that materially affected the fair conduct of the auction.
9.5 An auction may not be cancelled solely because the sale price is economically unfavourable for Interpyro or the seller.
10. Formation of the purchase agreement
10.1 If a consumer validly wins an auction, a purchase agreement between Interpyro and the consumer is formed in accordance with these Terms and Conditions.
10.2 Interpyro may send the consumer an electronic confirmation after the auction ends.
10.3 The purchase agreement is recorded in Interpyro's administration.
10.4 From the moment the purchase agreement is formed, the consumer is obliged to pay the agreed price and any additional costs, subject to statutory consumer rights.
11. Prices and costs
11.1 The consumer pays the bid amount it won, plus the applicable costs, taxes and any buyer's fees indicated on the platform.
11.2 All costs relevant to the consumer are displayed as clearly as possible before the purchase agreement is concluded.
11.3 If statutory provisions require certain costs to be displayed or calculated differently, those statutory provisions apply.
12. Payment
12.1 The consumer pays the amounts owed to Interpyro.
12.2 Interpyro may make use of external payment service providers.
12.3 Payment is only deemed received once it has actually and definitively been received by Interpyro or the relevant payment service provider.
12.4 If a payment is reversed, refused, or charged back, Interpyro may handle the relevant order and/or account in accordance with the applicable statutory provisions.
12.5 In the event of default in payment, Interpyro may, to the extent legally permitted:
- a. give the consumer notice of default;
- b. suspend further performance;
- c. temporarily block the account;
- d. prevent further bids;
- e. terminate the purchase agreement where legally permitted;
- f. claim statutory damages and costs.
13. Pickup
13.1 Consumer fireworks are not shipped to the consumer by Interpyro.
13.2 The consumer must personally collect the purchased products from the affiliated German vendor indicated on the order.
13.3 Handover only takes place within the statutorily permitted period.
13.4 For F2 consumer fireworks, the statutory sales and handover period as established by German law applies.
13.5 The consumer receives information about the relevant pickup location and, where applicable, the pickup time via the platform.
13.6 The vendor must check the order at pickup and identify the consumer in accordance with the statutory requirements.
14. Statutory sales period
14.1 For F2 consumer fireworks, handover only takes place within the statutorily permitted sales period.
14.2 If the statutory sales period is amended by legislation, government decisions or other binding regulations, the statutory arrangement in force at that time automatically applies.
14.3 No provision of these Terms and Conditions gives the consumer the right to receive fireworks outside the statutory sales period.
15. Non-collection by the consumer
15.1 The consumer is responsible for collecting its order on time.
15.2 If the consumer does not collect the order within the indicated period, Interpyro may handle the order in accordance with the applicable statutory provisions.
15.3 To the extent legally permitted, reasonable and demonstrable costs arising from non-collection may be charged to the consumer.
15.4 If fireworks may no longer be handed over due to statutory regulations, the relevant products are dealt with in accordance with those statutory regulations.
16. Non-delivery by the vendor
16.1 The vendor is obliged to actually make every product sold through Interpyro available for handover to the consumer.
16.2 If the vendor is unable to deliver a sold product, or unable to deliver it in full or on time, the vendor must inform Interpyro immediately and before the scheduled pickup.
16.3 A lack of stock after a product has been sold through Interpyro constitutes a failure on the vendor's part if attributable to the vendor.
16.4 The fact that a vendor has sold the product elsewhere, lost it, registered it incorrectly, or held insufficient stock does not release the vendor from its obligations towards Interpyro.
16.5 A vendor may not cancel a sale solely because the realised sale price is lower than expected.
17. Refunds to the consumer
17.1 If an order cannot be fulfilled and the consumer is entitled to a refund under applicable law, Interpyro will treat the consumer in accordance with its statutory obligations.
17.2 If the cause of the refund lies with the affiliated vendor, Interpyro has a right of recourse against that vendor for all amounts Interpyro has had to pay to the consumer or other third parties as a result.
17.3 The consumer's statutory rights against Interpyro are not limited by the internal allocation of liability between Interpyro and the vendor.
18. Vendor liability
18.1 The vendor is responsible to Interpyro for any failure attributable to it in the performance of an order sold through Interpyro.
18.2 This includes, among other things:
- a. non-delivery;
- b. partial delivery;
- c. lack of stock;
- d. selling a reserved product to a third party;
- e. incorrect product information;
- f. incorrect product category;
- g. non-conforming products;
- h. incorrect storage;
- i. violation of fireworks regulations;
- j. lack of required permits;
- k. incorrect age verification;
- l. incorrect handover;
- m. fraudulent acts;
- n. auction manipulation;
- o. conduct of employees or engaged third parties.
19. Compensation and indemnification by the vendor
19.1 The vendor is obliged to fully indemnify Interpyro for damage, costs and claims arising from a failure or violation attributable to the vendor.
19.2 To the extent legally permitted, this obligation includes, among other things:
- a. amounts to be refunded to consumers;
- b. payment service provider costs;
- c. chargeback costs;
- d. bank charges;
- e. administrative costs;
- f. reasonable customer service costs;
- g. reasonable collection costs;
- h. reasonable external legal costs;
- i. damages;
- j. consumer claims;
- k. costs of alternative solutions;
- l. costs of re-listing products;
- m. other demonstrable damage and costs.
19.3 The vendor indemnifies Interpyro against third-party claims arising from the acts or omissions of the vendor, its employees, representatives or engaged third parties.
19.4 The vendor's liability towards Interpyro is not limited by any liability limitations Interpyro may apply towards consumers.
20. Payout to the vendor
20.1 Once the consumer has paid the purchase price to Interpyro and the payment has been definitively received, the affiliated vendor is entitled to payout of its sales proceeds in accordance with the payment terms agreed between Interpyro and the vendor.
20.2 Interpyro aims to process payouts as quickly as possible, for example applying a payment term of one to three business days.
20.3 Interpyro may deduct the agreed commission, payment costs and other amounts owed prior to a payout.
20.4 Interpyro may also hold a limited security reserve to cover possible refunds, chargebacks, failures, claims and other obligations of the vendor.
20.5 The amount of this security reserve may depend on, among other things:
- a. the volume of sales;
- b. the vendor's experience;
- c. previous transactions;
- d. the number of complaints;
- e. the risk of refunds;
- f. financial reliability;
- g. the type of products;
- h. other reasonable risk factors.
20.6 A higher reserve may apply to new or higher-risk vendors.
20.7 Interpyro may reduce the reserve for reliable vendors.
20.8 Interpyro may suspend a payout in whole or in part if there is a reasonable suspicion that the vendor will not fulfil its obligations.
20.9 Once the relevant obligations have been settled, the remaining reserve is paid out to the vendor, provided no other claims exist.
21. Set-off
21.1 To the extent legally permitted, Interpyro is entitled to set off its due claims against the vendor with amounts Interpyro owes to the vendor.
21.2 If, for example, a vendor has already been paid for an order that subsequently cannot be fulfilled due to a failure attributable to the vendor, a claim by Interpyro against the vendor arises.
21.3 Interpyro may set off this claim against future sales proceeds, reserves and other amounts owed to the vendor, to the extent legally permitted.
22. Suspension of payouts
22.1 Interpyro may suspend payouts in whole or in part if:
- a. a vendor fails to fulfil orders;
- b. there are indications of fraudulent conduct;
- c. there is an increased number of complaints;
- d. a vendor may have violated statutory regulations;
- e. a vendor may have insufficient stock;
- f. there are chargebacks;
- g. there are outstanding claims;
- h. there is reasonable cause to fear that the vendor cannot fulfil its obligations.
22.2 A suspension shall not last longer than reasonably necessary to establish and settle the relevant risks or claims.
23. Product liability
23.1 The vendor guarantees that all products offered through Interpyro are safe and lawfully permitted.
23.2 If a product appears to be potentially dangerous, prohibited, non-conforming or otherwise unsuitable, Interpyro may immediately remove the relevant listing.
23.3 The vendor is obliged to immediately inform Interpyro of:
- a. product recalls;
- b. safety issues;
- c. official warnings;
- d. changes in statutory approvals;
- e. bans or restrictions;
- f. other circumstances that may affect the marketability or safety of a product.
23.4 The vendor is responsible for all consequences of products it has offered or stored in violation of statutory regulations.
24. Fraud and bid manipulation
24.1 It is prohibited to artificially influence the bidding process.
24.2 This includes, among other things, a prohibition on:
- a. bidding on one's own products;
- b. having staff place bids;
- c. having family members or third parties bid with the aim of driving up the price;
- d. using multiple accounts;
- e. creating fake accounts;
- f. artificially inflating bids;
- g. misleading other users;
- h. manipulating technical systems.
24.3 In the event of a violation, Interpyro may, to the extent legally permitted:
- a. declare bids invalid;
- b. cancel auctions;
- c. block accounts;
- d. exclude vendors;
- e. suspend payments;
- f. recover damages;
- g. prohibit further participation;
- h. inform the competent authorities.
25. Account and registration
25.1 The user must provide accurate and up-to-date information.
25.2 Use of another person's account is not permitted.
25.3 The user is obliged to keep its account details confidential.
25.4 Interpyro may temporarily or permanently block an account in the event of:
- a. fraud;
- b. abuse;
- c. payment problems;
- d. bid manipulation;
- e. provision of incorrect information;
- f. violation of legislation;
- g. violation of these Terms and Conditions;
- h. a serious security risk.
26. Technical faults
26.1 Interpyro aims for reliable operation of the platform but cannot guarantee permanently fault-free operation.
26.2 Interpyro is not liable for faults that lie outside its reasonable sphere of influence.
26.3 This includes, among other things:
- a. internet outages;
- b. hosting provider faults;
- c. payment provider faults;
- d. power outages;
- e. telecom faults;
- f. cyberattacks;
- g. overload;
- h. maintenance;
- i. software errors;
- j. faults at external services.
26.4 If a technical fault has materially affected the bidding process, Interpyro may cancel or re-run the relevant auction to the extent legally permitted.
27. Force majeure
27.1 Interpyro is not liable for failures resulting from circumstances reasonably beyond its control.
27.2 This may include, among other things:
- a. government measures;
- b. changes in fireworks regulations;
- c. sales bans;
- d. safety orders;
- e. recalls;
- f. fire;
- g. explosions;
- h. natural disasters;
- i. war;
- j. pandemics;
- k. serious transport restrictions;
- l. other exceptional circumstances.
28. Consumer rights and withdrawal
28.1 Statutory consumer rights remain fully in effect.
28.2 If the consumer has a right of withdrawal under applicable German law, this right is not limited by these Terms and Conditions.
28.3 If a statutory exception to the right of withdrawal applies to a particular online auction or purchase, Interpyro will inform the consumer accordingly, in line with its statutory information obligations.
28.4 The consumer retains all mandatory statutory rights regarding defective or non-conforming products.
29. Complaints
29.1 Complaints can be submitted via the contact options indicated by Interpyro.
29.2 Interpyro may refer complaints relating to the physical fulfilment of the order to the relevant vendor.
29.3 The vendor is obliged to fully cooperate in handling complaints.
29.4 Referring a complaint to a vendor does not limit the consumer's statutory rights against Interpyro.
30. Interpyro's liability
30.1 Interpyro is liable in accordance with mandatory statutory provisions.
30.2 To the extent legally permitted, Interpyro's liability for slight negligence is limited to foreseeable and typical damage.
30.3 This limitation does not apply to:
- a. damage to life, body or health;
- b. intentional conduct;
- c. gross negligence;
- d. liability that cannot be excluded or limited under mandatory law;
- e. other liability that cannot be limited by law.
31. Vendor liability for statutory violations
31.1 The vendor is independently responsible for complying with all statutory regulations relating to:
- a. storage;
- b. sales;
- c. possession;
- d. transport within the scope of its business activities;
- e. pyrotechnic products;
- f. permits;
- g. age verification;
- h. product safety;
- i. workplace safety;
- j. fire safety;
- k. other regulations applicable to its business activities.
31.2 The vendor indemnifies Interpyro, to the extent legally permitted, against damage and claims arising from the vendor's failure to comply with such regulations.
32. No shipping
32.1 Interpyro does not ship consumer fireworks to consumers.
32.2 The consumer is obliged to personally collect fireworks from the designated German vendor partner.
32.3 Interpyro does not accept requests to ship fireworks via regular mail, parcel or courier services if this is not legally permitted.
33. Use and export outside Germany
33.1 The products are intended exclusively for the German market.
33.2 The buyer may only take a product outside Germany if it has independently determined in advance that this is permitted under all applicable legislation.
33.3 All consequences of such cross-border movement are entirely at the buyer's own expense and risk.
33.4 Interpyro is not responsible for obtaining foreign permits or for checking foreign regulations.
34. Intellectual property
34.1 All texts, images, software, logos, designs, databases and other content of the Interpyro platform belong to Interpyro or its licensors, unless stated otherwise.
34.2 It is prohibited to commercially copy, distribute or use this content without permission.
35. Privacy
35.1 Personal data is processed in accordance with applicable German and European privacy legislation.
35.2 Interpyro's separate privacy policy applies to the processing of personal data.
36. Online marketplace and information obligations
36.1 Interpyro will comply with the statutory information obligations applicable to its online platform.
36.2 To the extent legally required, Interpyro informs the consumer about, among other things, the identity and trader status of relevant trading parties and other legally prescribed information.
37. Storage of contract data
37.1 Interpyro may electronically store bids, orders, payments, communications and other relevant transaction data.
37.2 This data may be used for administration, performance, evidentiary and settlement purposes, to the extent legally permitted.
38. Amendment of the Terms and Conditions
38.1 Interpyro may amend these Terms and Conditions if necessary due to:
- a. changes in legislation;
- b. court rulings;
- c. decisions of competent authorities;
- d. new technical functionality;
- e. new services;
- f. security requirements;
- g. other legitimate reasons.
38.2 Amendments have no retroactive effect on purchase agreements already concluded, unless mandatory law provides otherwise.
39. Applicable law
39.1 The contractual relationship between Interpyro and the consumer is governed by the law of the Federal Republic of Germany, to the extent legally permitted.
39.2 Mandatory consumer-protection rules applicable under applicable European or national law remain unaffected.
40. Competent court
40.1 The statutorily competent court applies for consumers.
40.2 A deviating choice of forum is only valid if and to the extent permitted under applicable legislation.
41. Language
41.1 The legally binding version of these Terms and Conditions is drafted in the German language.
41.2 Dutch, English or other translations are provided for information purposes only.
41.3 In the event of discrepancies between translations and the German version, the German version prevails, to the extent legally permitted.
42. Severability
42.1 If a provision of these Terms and Conditions is wholly or partly invalid, the remaining provisions remain in full force.
42.2 The invalid provision is replaced by the applicable statutory arrangement.
43. Final provisions
43.1 Together with product information, order confirmations, price information, auction information and other applicable supplementary terms, these Terms and Conditions form the contractual basis for purchases via Interpyro.
43.2 The statutory rights of consumers remain fully in effect.
43.3 If a provision of these Terms and Conditions conflicts with mandatory law, the mandatory law prevails.
